The Lok Sabha’s Bold Move: Removing Ministers in Custody



Home Minister Amit Shah has taken a bold step that has made the Parliament’s Monsoon Session highly heated. He introduced three new bills in the Lok Sabha, one of which proposes that if any Minister, Prime Minister, or Chief Minister remains in judicial custody for 30 days in connection with a serious criminal charge (punishable with five years or more of imprisonment), they will have to vacate their office. If they do not resign voluntarily, their position will be automatically terminated.

2. Government of Union Territories (Amendment) Bill, 2025 – This bill ensures that ministers in Union Territories (such as Delhi, Puducherry, etc.) will also be subject to the same    30-day custody rule if facing criminal charges. Earlier, the removal mechanism for UT ministers was unclear, but this amendment seeks to fill that gap through law.


3. Jammu & Kashmir Reorganisation (Amendment) Bill, 2025 – This bill has been created specifically for Jammu & Kashmir. If any minister in J&K remains in custody for 30 days, their position will automatically be terminated, following the same rule that applies to the Prime Minister and Chief  Minister.
